As of December 2015, new regulations have come into force that allow ESDC to conduct inspections of employers who employ Temporary Foreign Workers, require information concerning their wages and working conditions, audit their payroll, and even attend at employer premises without prior warning. Employers who are found non-compliant with the terms of engagement of foreign workers can be subject to significant fines and even banned from the Temporary Foreign Worker Program.

Employers need to be aware of these regulations and be prepared for potential inspections and audits by being proactive and ensuring that all foreign workers in their organization are appropriately documented, and any deficiencies are corrected before they become serious issues with potentially devastating consequences.

Sergio Karas is a lawyer and certified specialist in Canadian Citizenship and Immigration Law by the Law Society of Upper Canada and an internationally recognized expert in Canadian immigration law. He is also an instructor in immigration law at Sheridan College in Toronto. Sergio is a member of the Law Society of Upper Canada and the Canadian Bar Association, Past Chair of the Citizenship and Immigration Section of the Ontario Bar Association, Past Chair of the Immigration and Nationality Committee of the International Bar Association, and Vice-Chair of the Canada Committee of the American Bar Association Section of International Law. He is also a member of the Inter-Pacific Bar Association and the American Immigration Lawyers Association. He is listed in “Who is Who in Corporate Immigration Law” as a leading immigration lawyer.
